Gate should not be kept locked
It was therefore of interest to me, especially as a resident of Old Roar Road, to read the letter from Dennis Wise in last week’s paper. He makes some very good points but fails to comment on the critical issue concerning maintenance of the road.
A large number, but not all, properties in the road have covenants ( a form of legal obligation) in their deeds to contribute to maintenance of the road, and those of us that use the road in cars certainly have a moral duty to do so. However, local residents not only withhold maintenance money due to poor maintenance but because access through the gate at the north-east end of the private road is denied to us.

Hide AdMany properties have easements (a stronger legal right than a mere covenant in that it is actually a form of ownership in the private road) in their deeds giving them access through the gate now kept locked by the road owners.
If the owners of the road complied with their obligations to provide a full right of way then residents would have no reason to withhold maintenance payments.
I take comfort in the knowledge that Home Secretary Rudd, being protector of our legal rights, will act to draw this matter to the attention of one of her disciples and the other shareholders of The Old Roar Company so that it can be speedily corrected.
I for one would not want chattering about ‘nasty party’ or ‘cronyism’ to circulate any more than it does already as we all need to uphold the status of public office and the rule of law.
